Seed Talent Budtender’s Choice Awards

By entering into the event space and participating in the Seed Talent Budtender’s Choice Awards event, I confirm that I am at least 21 year of age.
I also understand that cannabis will be consumed in this space, and agree to the following:
WAIVER AND RELEASE OF LIABILITY
IN CONSIDERATION OF the risk of injury that exists while participating in CANNABIS CONSUMPTION (hereinafter the “Activity”); and INCONSIDERATION OF my desire to participate in said Activity and being given the right to participate in same;
I HEREBY, for myself, knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity; and
I HEREBY release and forever discharge TALENT HIGHWAY CORPORATION DBA SEED TALENT (‘Seed”) , located at 171 W. Aberdeen, Suite 400, Chicago, IL 60607, and P. COOPER CREATIVE LLC, DBA HIGH-MINDED EVENTS (“High-Minded Events”), located at 1761 W. Morse Avenue, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively “Releases”), from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned Activity.
I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED THE PARTICIPATING IN THE ACTIVITY. I ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY.
I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs.
I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that I should require medical care or treatment, I authorize High-minded Events to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
I FURTHER ACKNOWLEDGE that this Activity may involve a test of a person’s physical and mental limits and may carry with it the potential for death or serious injury. I agree not to participate in the Activity unless I am medically able and properly trained, and I agree to abide by the decision of High-minded Events, regarding my approval to participate in the activity.
I FURTHER ACKNOWLEDGE that I will comply with all event terms below and as shall be updated and disclosed prior to the event or posted the at the event. These include but are not limited to restrictions on where consumption may be allowed and in what specific forms and specifically excluded forms.
I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “WAIVER AND RELEASE” AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE HIGH-MINDED EVENTS AND SEED AND ALL OF THEIR AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST High-minded Events FOR PERSONAL INJURY OR PROPERTY DAMAGE.
THIS AGREEMENT was entered into at arm’s-length, without duress or coercion, and is to be interpreted as an agreement between all parties of equal bargaining strength. Participant, Seed and High-minded Events agree that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted to alter or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
I, PARTICIPANT, AFFIRM THAT I AM OF THE AGE OF 21 YEARS OR OLDER, AND THAT I FULLY UNDERSTAND ITS CONTENT AND THAT THIS RELEASE CANNOT BE MODIFIED ORALLY. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT THAT I AM ENTERING TO OF MY OWN FREE WILL.
Event Terms - Seed Talent Budtender’s Choice Awards 2024
1. Consumption Areas: Cannabis consumption is only permitted within designated consumption areas as outlined by event organizers. Cannabis consumption is allowed in the venue in the form of vapes and dabs, and outside on the fenced-in patio of the venue in the form of combustibles, vapes and dabs. Consumption in non-designated areas is strictly prohibited.
2. Age Restriction: All attendees must be of legal age 21+ as per local regulations to consume cannabis products and attend the event. Valid identification is required for entry.
3. Cannabis Product Restrictions: Only cannabis products provided by approved vendors at the event are permitted for consumption. Bringing in outside cannabis products is strictly prohibited.
4. Responsible Consumption: Consumption of cannabis must be done responsibly and in moderation. Any behavior deemed irresponsible or disruptive by event staff will result in immediate expulsion from the event.
5. No Smoking Zones: Smoking cannabis is only permitted in designated smoking areas. Smoking in non-smoking zones, including on the street, sidewalk or outside the venue premises, is strictly prohibited.
6. Safety Precautions: Attendees must adhere to all safety precautions outlined by event organizers, including but not limited to fire safety regulations and proper disposal of cannabis products.
7. Alcohol Consumption: Consumption of alcohol in not permitted. Mixing cannabis consumption with alcohol consumption is strongly discouraged. Any behavior deemed irresponsible or disruptive by event staff, and if an attendee is found inebriated due to alcohol consumption of their own volition, will result in immediate expulsion from the event.
8. Compliance with Local Laws: All attendees must comply with local laws and regulations regarding cannabis consumption. Event organizers are not liable for any legal consequences resulting from non-compliance.
9. Event Security: Event staff reserves the right to conduct security checks and searches on attendees to ensure compliance with event rules and regulations.
10. Designated Transportation: Attendees are encouraged to arrange for designated transportation to and from the event to ensure their safety and the safety of others on the road. Rideshare and/or public transportation is highly encouraged.
11. Prohibited Items: Prohibited items include but are not limited to weapons, illegal substances other than cannabis, and any item deemed by event staff to be potentially harmful or disruptive.
12. Consent to Photography: By attending the event, attendees consent to being photographed and filmed for promotional purposes, including any close-up or identifiable shots.
13. Event Liability: Attendees participate in the event at their own risk. Event organizers Seed Talent and High-Minded are not liable for any accidents, injuries, or damages incurred during the event.
14. Event Cleanup: High-Minded Events is responsible for ensuring that any areas used for cannabis consumption are properly cleaned and restored to their original condition after the event.
Photo Use Release Form
I hereby grant and authorize Seed and High-minded Events the right to take, edit, alter, copy exhibit, publish, distribute, and make use of any and all pictures or video taken of me by High-minded Events to be used in and/or for legally promotional materials including, but not limited to newsletters, flyers, posters brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, social networking sites and other print and digital communications, without payment or any other consideration. This authorization extends to all languages, media, formats and markets now known or hereafter devised. This authorization shall continue indefinitely, unless I otherwise revoke said authorization in writing.
I understand and agree that these materials shall become property of Seed and High-minded Events and will not be returned.
I hereby hold harmless, and release Seed and High-minded Events from all liability, petitions, and causes of action which I, my heirs, representative, executors, administrators, or any other persons may make while acting on my behalf or on behalf of my estate.
I warrant that I am of the age of consent (21 years or older) and that I am competent to contract in my own name. I have read this release before entering the event and I fully understand the contents, meaning and impact of this release.
